Yeah, already working on the security deposit. Really isn't any damage now, and we'll patch all the holes form hanging pictures ans what not. Also, I have a free attorney and he doesn't, so I will be all over the laws on this one. I have one month to mkae sure this place is in great shape when we leave.

When I lived in my apartment I had noisy neighbors upstairs. Usually I just banged on the ceiling and they turned it down for the night. I never actually reported them since it wasn't all the time, and usually on weekends. There was one time they were just making too much damn noise at about 11:30 at night... so I lifted up my 12" sub box to the ceiling while my roommate started playing rumpshaker at full volume with the bass cranked for about a minute. ...needless to say, they finally got quite.

I've been the noisy neightbor in my house as well. Neighbors just called and asked me to turn it down, so I did. I get along good with them still.

Now for your deposit...I pulled this off a site. Maybe your lawyer friend can help you get you deposit...

Your last choice is to take them to court. You can sue your noisy neighbor in small claims court for unreasonably interfering with your enjoyment of your property. Depending on the state you live in, you can ask the court for $2,000 to $5,000. But you must be able to show that there is excessive and disturbing noise, that the enjoyment of your property is diminished, and that you have asked the neighbor to turn stop the noise (your letter should prove this).
I'd say betwwen the document police calls (whether they show up or not) and the fact the land lord is sick of the complaints.... just a thought.

That'* what we are thinking too. We have 7 pages of documented incidents on the computer in Word. We also have a copy of the letter I sent the Landlord and one to the neighbors.

Definitely explore your options before giving up. There are several laws in place that protect tenants in situations like this. I would explore legal avenues and tenant rights before throwing your arms up in the arm and being forced to leave.

Is the person upstairs so unreasonable that they can't even turn the volume down? This concept of ignorant and selfish behaviour is beyond me.

That is what gets us the most. These are 2 girls in their mid 20'* with college degrees. We used to be friends with them. The worst is when they have it on when we are trying to put the kids to bed. Why bring my kids into it.
Really put me over the edge is when they followed the wife home yesterday, knowing my daughter was with her.

I know in Oregon, you can contest your eviction up to 90 days RENT FREE before final eviction.

It makes it very tricky to get the right renters (I manage the duplex I live in for a friend, and it'* my responsibility to keep the other unit rented out to good people).

Well, my law firm is closed tomorrow, but first thing Tuesday I am talking to him about htis. I am going to take in the letter form the landlord and the lease and look into all of this.
I can imagine it is difficult to find good tenants and control them, but we never caused problems. We just wanted him to make it so we could live in peace.

Im not the violent type at all, but seeing a fellow B.C. Member trying to deal with this problem for months now just pisses me off. They have absolutly no respect for you at all. Very hot situation for me, respect goes a long way, and these two girls obviously show none of it and have no care in the world for you or your family in general. Let me tell you something if this was my situation. I would make these last 30 days living hell for them. I can write you a book on things to **** these disrespectful rodents off. You obviously sound like a great peacefull man who just wants to live in peace and enjoy the world with his family. I Would be glad to come over and backhand these two girls from hell. Sorry im not the violent type but this just gets my blood boiling.

Yeah, believe me, I want to get violent too, but that won't do any good.

Just to clarify too, the main thing with the music is that it is intentional.
We have NEVER once came home and they had it on. They only do it when they know we are home. The worst is when the one was on the porch getting mail and saw me coming home. By the time I parked and got inside, she had the music cranked up.
Yeah, I pressed harassment charges for that one and we are going to the district magistrate in a few weeks.

Man. Sorry to hear about this. Let me know how things go and when you plan on moving and maybe I can make it out there to help with that.
