Dealership rip-off - May 14, 2008 update - PAGE 22
Ok, getting paperwork ready to go to SCC. Unfortunately I don't even have $35 right now to go forward yet. :( This is what I have on the paperwork for the amount I am suing and my brief description of the nature of the claim. Does this sound adequate?

I'm asking for $400 from him, for what is missing and for 600 of the 1200 miles, since by his own words 600 miles are unaccounted for. While I doubt the car was even test-driven 600 miles, he says that is ALL that was added, and since numbers don't lie, 600 miles are unaccounted for.
48¢ a mile x 600 = $288, plus missing/damaged items = $400.
I'd love to sue him for the full 1200 miles. I'd also like to sue him for the $1000s I've spent on the car while he drove it around town for 8 months, but I don't think it would be good if I appeared greedy. Maybe the owner'* own stupidity and ignorance in front of a judge would be enough to be issued a larger winning? lol
I dropped my car of at Bernardo Motors LLC on May 14, 2006 for Dave Taylor to sell on my behalf as a consignment service he offered to me. Almost 8 months went by and I did not receive any phone calls from Dave Taylor with people interested in my car. On January 5, 2007 he finally called with one offer. I turned down the offer and on January 14, I went to pick my car up because he was not selling it for what I asked him to. My car was missing from his lot on the 14th, and I finally picked it up on the 16th. I have been seeking reimbursement since then for things that were missing and damaged, and for excessive miles that were added on my car and unaccounted for from Dave Taylor'* own statements. Front floormats are missing, a window shade is broken, a second electronic ignition key is missing, and almost 1200 miles were added since I dropped it off at his dealership. David Taylor said I would get reimbursed for all these things but after almost 5 months I have not received anything.

Heres a question, Technically - on camera he said HE would reimburse you. He did not say the compnay would... a very dangerous slip of the tongue if you ask me. Have you involved a lawyer in any of this?
Dangerous how? Are you saying that suing the company won't work since he himself said he would reimburse me? As an LLC, he would be protected personally, though I could probably still sue HIM as an individual. But saying he would reimburse me to me means him being the owner of the company.
Should I change the wording to reflect that I am suing the COMPANY and not mention his name so much? Should I state more to the effect of why the COMPANY is responsible for reimbursing me?
I haven't involved any lawyers and won't hire one for this. If I need to I'll ask for advice from a co-worker whose husband is a lawyer.

Dangerous as in HE accepted responsibility for reimbursing you personally, opening himself and his assests; if you get my meaning.
Again, this is all unexplored territory for me as well; I've got a dead beat contractor that won't return my calls or refund my deposit.. that why I'm paying close attention to what your going thru

I would speak to a lawyer...
and what about your insurance and licensing fee'* while he had your car you need to go after more to get what you want.

I think no matter what his personal assets are protected as he is a "member" of the LLC. One of the benefits of them. But as long as I get my $400 I'll be happy.
I'm broke...anyone want to donate $35 so I can start the court process? I'll refund it once I win.

EDIT: Rob, I didn't pay any fees to have him hold it on his lot. I'm not OUT money besides what is missing/damaged.
