your insurance will only pay up to the limits of your liablility. The guy can then try to sue you in civil court if the amount paid out by the insurance company isn't enough to compensate him for medical bills, etc. I don't know what you currently carry for liablility limits but if I were you I would increase them to at least 25/50/50 or 50/100/50. What that means is $25,000 per person bodily injury but no more than $50,000 per accident and $50,000 property damage.

My insurance will cover what he wants. They said he'll probably get one fifth of that, $10, 000.

You can't sue anybody in a case like that here - no-fault insurance and a public health system. This has its' drawbacks, but frivolous lawsuits isn't one of them

P.*. I guess your mental anguish and stress could make for a sizable countersuit :P

Well, to blow the dust off this one, the guy got 205,000. I hear it was finally settled a couple months ago. They had asked for up to a quarter million. I never did anything but talk to the lawyer for a little while. I hope he enjoys his Escalade he bought. When I called the lawyer to inquire about the case, he told me it'* one of the first things the guy did.
