Buddy if these were the problem you were having we would have repaired the car for $200 in parts, and for another $60 had a cat shipped to my front door and later installed for a small fee... In totall you may have spent $300 ....

Man, awefully chivalrous of you to say As of now all work has been halted and I am in 4.5 hours of labor. What makes this situation even worse is that I really live in upstate NY, and the car is stuck at a dealer just outside Montreal, QC. Anyone from the Montreal area who would like to loan me a garage and tools?! LOL ok, I can bring my tools...

Have you threatened to file a case against them in court? They really don't want to send an attorney somewhere to defend them. It'* cheaper to repair the car.

My main obstacle is this: The warranty contract states that the emissions system is not covered for replacement/repair. There is also a provision that states:
E. WHAT IS NOT COVERED
1. MECHANICAL BREAKDOWN OR FAILURE:
n. Of a covered part damaged by a non-covered part, or of a non-covered part damaged by a covered part
So even if I can prove that the EGR system and Catalytic Converter were functioning normally, and just the UIM failed, in essence it was the heat generated by the EGR stovepipe that caused it. I don't think I could win, no matter what spin I try. I'm trying to take the position that the intake failed because of the lack of resistance to this heat, i.e. a poor choice of material for the engineers to choose, but it doesn't change the fact that it'* was the heat eminating from the EGR system. Any suggestions?

The EGR system didn't fail though. It worked properly. By working properly it put the expected temperatures and gasses where the engineers designed it to.

Actually, I can just reflash the PCU no? My main problem will be the wiring harness. Pricey from the dealer and I will have to find one from a similar SSEi with all the options, so I don't end up with missing terminations, I'd rather have extra. This should be all moving to another thread methinks... any suggestions?
