Quite the situation. If she can prove that the manhole was not visible, then I think the city/town should cover at most, the cost to fix the oil pan. Whoever tried fixing it should be responsible for fixing anything that was damaged by the "explosion"

i agree, but you have to wonder how fast she was going and what she was doing on that road in the first place. you should know if your driving a transam you cant drive down roads that look like that and even if your made to you slow down to nothing so if you bottom out it wont take out your oil pan.

Well first off.how can she blame it on sighns..she cant even speak english let alone read it..And if your such a poor driver that you cant see a hole in the road you shouldnt be driving..I dont see how people who cant speak english cant get drivers liscences here sue to like above mentioned how will they be able to read sighns in a language they dont understand

If no signs, then she has a claim. It'll be hard to prove that one though unless she took pictures to show there were not signs.

Also, I bet she reads English just fine, and probably speaks it too. She probably just doesn't speak it very well to conduct a news interview so she went with the more comfortable language.

Seems to me the guys who tried to fix her oil pan with a welder made it into a big issue.
Also by attempting to repair the car I think that implies accepting responsibility.

So English isn't her first language and she'* a woman, so what?, if she is legally in the country she has no more and no less protection by the law than anyone else including civil liability.

When I visit the USA I conduct myself according to your laws and would expect to be treated accordingly.

Hey out here. I work for the city, have to pull manhole covers all the time. Almost been clipped too many times, and last time it was some dumb kid in a trans am going 40+ down a residential road where the speed limit is 25 tops here. Almost whipped the wrench at his rear windshield. I use cones. I have lights on the truck. I park the truck to block me as much as possible now, sometimes leave doors open depending on situation. People here are just stupid. only explanation. Not saying that was the case with her. But...really. welder to the oil pan? I'm not a welder....but I would take it off, clean it first, then weld....What does the battery have to do with that? Did they say LA as in Los Angeles? That just explains it all. Another case of fricken stupid. Construction crew prolly screwed up, but she shoulda noticed the cover sticking out enough to puncture the oil pan. and on that road, shoulda been going slow in that thing. Its everyones fault, if she is telling the truth.
