In most places, a private citizen (non-law enforcement) can do it and it does not violate any Constitutional laws.

That is right. In fact you have all rights except of the use as evidence in the trial.

well that explains a lot. i run into this alot in a day'* work. i always thought it was just because they couldnt be sure who they were talking too. i guess i understand now. i think it should be illegal to do that sort of thing.
