Default Neighbour Issues

*Big sigh*

I hate my neighbour! He is such an *******! Now, let me start off with the story.. this will take a bit to read.. so I hope you don't mind reading some boring ****.

Now in late Spring/ early Summer, I recieved the Bonneville. Then, during the Summer, I frequently worked on the Bonneville. Not every day, but I would say 3 days out of the week, at the least. Until I started tearing apart the dash, then it was 5 days a week. Anyways, at first I didn't listen to music, due to the interior lights draining too much juice, draining my battery, and I didn't have a charger. After I fixed the problem [removing the interior light fuse], I begun listening to music. At first, it was too loud. But, my mom gave me an "acceptable listening volume."

Which I stuck to. Now, let me skip ahead a little. Every single person who has heard my music playing, believes it is an acceptable level. My mom'* boyfriend, my mom, myself, family friends, etc. If anyone who has an 87-91 with the UT4 HU [tape deck, with no *****, and steering wheel controls. Pretty much standard on SSEs] it is on the first volume up on the third triange [you know how you need to press the volume up twice to get one triangle? well this is the first triangle]. I also have the gain at only about 50% [too bassy when sitting in the back]. Now that the volume is established. I also listen to classic rock. Nothing heavy. In fact yesterday I was litening to Tom Petty [Full Moon Fever album], usually I put on some Pink Floyd, Styx, or Rush.

Alright, back on course we go. So throughout the summer I listened to music whilst I work on my car. I have two houses beside me, one the owner is never there, the other the owners are there about 20 days out of the Month. Now, there is also a house behind mine. This is the neighbour in question. He is from Chicago. He comes here on Holidays, weekends [9 times out of 10], but most of the times he is not home during the week. Throughout all the time, NOBODY but this douche has complained. Anyways, so throughout the summer he would tell me to turn it down. I would usually comply, because my mom was at work, and nobody would be there to stop me if I got into an altercation. Then, it started getting worse, he would tell me to turn it OFF. So I told him No, and that if he wants to complain, he needs to talk to my mom. So, that'* what he did. He came storming onto our property that night, and YELLED to my mom. Boy was she pissed, and when she gets pissed, she is scary. This little guy didn't complain for a while, lets just say that. Several weeks later he started just telling me to turn it off, or he would report my mom for making threats to him [I don't know what she said, but she denies threatening him, and I believe her. She doesn't threaten, she'll just act]. I just ignored him up to that point, until he would start coming onto our property, and physically turning it off for me [or at least attempting to]. That was war, once he touched my car. My mom saw this, and scared the hell out of him again. After that point, he started not coming back to this place for a while. Every once in a while he would, but he left me alone from there. Then during Autumn he regularly started coming back, and the complaints started again. This time over other ****. Literally. He sits in his backyard [about 5ft from the property line, facing OUR HOUSE!]. Anyways, we walk our dogs in our backyard, and there is dog **** in the yard. Well, he complained about dog **** being on OUR property, saying it attracts flies. I told him if he doesn't like the dog ****, he can clean it up himself. Well, he stopped complaining about that. During the winter he was never home. His son would come occaisionally, and on Saturday nights we would party [he'* like 23 or something], there were usually 5-10 more people there.. wasn't big, but decent sized. Then during the Winter when it was like 50* in January or whatever, I started working on the car again. Well, he was back at that point. And he was done just talking to us, and called the cops on me.

In our township, the noise law is no matter the level, it is fine until somebody complains. It can be 300db, but if nobody complains it is legal. So, basically the cops don't give a **** about the level. So the cop showed up, and told me that I need to turn it OFF. I told him, that it is my God given right to listen to music, and I understand the laws and whatnot, but this is bullshit. I live here, he doesn't. If I want to do some work on my car, and listen to music, I damn well should be able to. I put it a little better [me having a little record.. gotta be nice to the cops]. But, yeah. So, I had to turn it off. He also said next time he needs to come back, that he will cite me for the music, broken windshield, lack of insurance [I actually just don't know where I put the proof of it], and for the car being abandoned and exposed. He said the minimum those would add up to is $750, but higher if I were an *******. Now to add to that list, I also have expired tags.. so it probably would be $800. Now, I told him, there is nothing wrong with a parked car having a broken windshield, and he said since the car is considered abandoned it is [does this make sense to you guys???].

Flash forward to yesterday, he called the cops again. However, this time he was three hours too late, and I even had the car covered up. Well, thank God, that my mom is an EXCELLENT liar. And she said that she was home that morning [really at work], and that I was inside with her. So, that avoided the cite [she KNOWS that I don't have the money for that, and she doesn't either]. We thought this was the end. We were pissed at first, but after that we calmed down. By this morning he blew it off, and decided ignoring him is the best answer. Until later that morning. My mom went out to walk our dogs [in our backyard]. As she was walking back to the house, which she hadn't even passed our garage at that point, he walked out, and had a fairly irate tone. And he said "Cathy [my mom'* name], Cathy, please walk your dogs elsewhere, the dog poop attracts flies." She was once again pissed, but she just ignored him, not even giving him a single look during that time. But she was pretty damn pissed about it when she talked to me about it.

That is our story. You may be asking why you wasted all that time reading that.. well, I would be too. But, what I want to know is, what is my legal right to do about this? What can I do within my power to fight him? What is my capability as a citizen of this hellhole to try to fix this problem? I need to know legal ways to fix this.

Also, one last note, my mom is friends with a State Police Officer, and he said that it is my right to listen to music. Now, it need to be at a resonable level, however nobody can tell me to turn it off, other than an officer [which I think he may be overriding his power].

Wow that really sucks.....

If I were you I'd read and re-read the laws and then contact the police department.
I don't think they can call a car "abanndoned" if it'* on private property and it'* being worked on. I think they can only give you tickets about the broken windshield and stuff if you put it on the road.

But laws can be different in each city and even street.....
Where I used to live there was a bylaw for my street saying you can't keep a car "covered" in the front yard, or on blocks. So I had to store the car in the backyard for the winter. It'* a law to keep the street "beautiful". Once when I had the rims redone on the 91, it was on blocks for a week, and someone filed a complaint. But by the time it was filed and the police came by to enforce it (yet another week later) the tires were back on her. I explained to the officer why she was on blocks, and he agreed with me that some people are just too anal. He couldn't tell me who filed the complaint, because he wasn't going to charge or ticket me, since I had my wheels back on her.

whoa, wait a minute here. how far away is the guy from your car when you are listening to it w/ 3 triangles? i i would go 5-6 normally when i drove the thing with controversial music, and nobody ever complained. what would be funny is if you started nitpicking him to death.

The guys sounds like a major peckerhead!! I hate people like that. I would definately check into the law in your area. You might be able to file harassment charges against him or something. I mean , c'mon, if he comes onto your property and turns off YOUR radio without YOUR permission- that can't be right. Some people like use the legal system unjustly but in your case I would definately not let him get away with it.

My age? Why, I am 14. I understand your point that I am not going to get much respect. But, I shouldn't be unjustly punished because this guy is a dick. And it isn't just against me, it is also against my mom, so I don't think he is targetting me, but more us. Which is a different story, because my mom is 41, not 14.

If you look at this pic, you see the white house behind the car? That'* his house. If you look at this pic you will see my house [the car is in the exact same spot, btw]. One last pic, I promise. If you look at this pic you see my garage? All the way on the right, there is that yellow spot right above the hood? My car is about 7-10 ft forward from that point. All in all, it is probably 4-6 car lengths away. From rear bumper to right at his rear porch. And my car is just under 17ft long.. so that'* about 70-100ft away. Not exactly close, if you ask me. Also, we can barely hear anything in our house. We can usually hear it in the kitchen [the furthest back room], but passed that it is usually too faint to 'listen' but you still hear 'something.'

If one more thing like this arises, I think reporting this will be the answer. I'm really fed up with it.

Sorry buddy, being 14 you are pretty much hooped...parental involvement or not...

Even if your mom works something out with him, you'll probably still get harassed.

That might help some. Doesn't state the ordinances, but gives you the right numbers to call to find out what your rights are and what ordinances you need to comply with. I would start there.
