I got the feeling the insurance company isn't being completly honest. Apparlently someone got issued a summons and since I didn't get anything even after seeing the cop at the hospital to get my insurance and license back. I'm guessing the other guy is the one that got the summons and for what I don't know but I RELLY want to find out cause it could help me argue my case weather it was no license,insurance etc etc

All the info should be on the police report. You need to check into that. If you had anything to do with going through a red light it'* on you. Sometimes you have to substantiate your case. I work for one of the major providers and you would be amazed how people try to scam us. I think that is partially why I am so jaded/cynical of people. I would like to see that police report though. Were you in an area where they have the cameras to catch people running red lights?

I believe what you are saying but at the same time you gotta try and see it from the other side. It'* kind of like if you go to a prison- everyone is innocent. Check the police report and if there are codes down the sides let me know, I can call someone and try to get the info on the codes for you.

If you both had insurance, somebody has to give you money. Maybe work it out with yours to get money from them to fix your car, then they would have to get it from the other'* insurance.

If you are from NY, you won't see any money from their insurance if both cars were occupied. In your case, you both were driving down the road and he hit you. No fault in NY says that even if he was driving reckless and totalled your vehicle in the process, your insurance pays for the damage to your car and his pays for the damage to his car, end of story. The only resort is to sue said person, which is very hard to do if no tickets were issued. If the other guy got a ticket, then you can take them to court to try and get your money.

If you only had liability insurance (no collision), then you are **** out of luck. Its the risk everyone with liability only runs when they drive anywhere. You are basically treating your vehicle (no matter how safe of a driver you are) as a throw away because you and only you will pay for the repairs unless you have a viable lawsuit and can get a judge to agree with you.

I had a situation where someone literally ran over the front corner of one of my old cars in a parking lot (yes, tire marks on the bumper & hood). I called the police and they took all sorts of pictures and collected some trim peices of the persons truck that had fallen off as well as noted the paint transfer. A few days later he called in and reported it to the police and a week later I had a nice fat check for $2200 in my hand from the person. He got threatened with a ticket for reckless driving in a parking lot and the police told him he would get no ticket if everything was settled. I told him he would either pay what the dealership in town would charge to fix it or he would pay that plus whatever legal fees I would pay to sue him plus the ticket the police would issue. Either way I would have gotten my money and he chose the easy way out.

My dad Just put liability on it :( but I'm goning to see if I can do anything because he probably was the one that got issued the citation.

Just a word of caution... Be absolutely sure that you have a legal leg to stand on (so to speak) before instigating a legal battle. Get all of the facts (police reports, pictures, and if any citations were issued) and consult with an lawyer.

Really though, depending on the ticket issued, there isn't much you can do but suck it up. You will have to spend more $$$ to try to recoupe what you've already lost, and that isn't a sure thing that you will get anything back even with a lawsuit.
