Now see here in Indiana no vehicle can be purchased or traded by a minor. The only way a minor can buy and or trade a car is if the new car is under the parents name, and then the minor can sign off on the trade if it is in his name. So here, the kid would have a chance in court.

While this should be true, I doubt it is. It probably depends on the state, but in most States no contract made with a minor is valid nor binding. "All sales are final", "No warranty expressed...etc." does not apply when a minor is involved. Most likely the seller is screwed. Right or wrong, that'* the way it is.

Now, whether or not the buyer should be able to sue for "damages" is another issue. I know it'* the American way, but is it morally correct to hold someone else responsible because you did something stupid?
In Canada, the only contracts that are non-binding when a minor is involved are those for "necessities." Now, although transportation could be seen as a necessity, he already had a viable means of transport (the Integra), so thus the trade doesn't constitute a contract for a necessity, so he'* hooped.

And any lawsuit would be thrown out as frivolous in a heartbeat.
I missed the fact that this occurred in Canadia. Maybe the dude will get what he deserves then. Sadly, in the USA I believe the opposite would happen.

As far as i know, in the US there are a dozen different reasons a dealer couldn't/wouldn't do a deal like this. Contract law forbids it in all of the states i know of. In PA a minor can't get his own insurance, he can't file a registration etc. Plus the dealer could end up kissing his license goodbye.

A suit which involved settlement plus "pain and suffering" would probably be interpreted as him doing a whole string of stupid things. If he did the first one, he could easily screw up the rest on his own, too.

This kid needs some supervision. And maybe a good smack on the back of his head.

I don't know about the age thing, but if the motor does blow maybe he would have a chance with a lemon law? But, yeah, he is a moron for doing it.

Lemon laws only apply for cars 3 years old and newer, at least in Ohio

As far as I'm concerned, tough luck on his part. Maybe next time he'll do a little research before he dives into deals with devils head first...

I tend to think he'* screwed. Its obvious he can own his own car or he wouldn't have been able to sign over the Acura so his only recourse is if there is a mandatory warranty on any cars gotten thru a dealer. AS always; its a buyer beware world out there.

Even cars withover 100k here in NY get a 30 day bumper to bumper when purchased thru a dealer.
