Default Need help on Insurance Settlement.

So I finally got the offer for the settlement from the insurance company.

$4238.40 This includes.
-$2200.00 Medical and chrio bills
-2 days pay for missing work (which would be pretty close to about $430.00)
- Pain and suffer which is whats left. around $1500.00 if I subtracted correctly.

To me thats not enough for pain and suffering. I couldnt move my neck for a couple of days. I had to go to chrio 3 times a week for 2 months right there is about 15-20 hrs of driving there, waiting there, then driving back ect, coulldnt excersice during that time, or do some normal things.

I dont know how this whole thing works. I know you can counter it but give me some advise on this situation because I dont know where to go with this right now.

I am guessing you could fight and get more but the problem is everybody thinks insurance claims is a payday and its not. You are fit and healthy and just be happy you are still alive and not dead. Shoot I pulled my back trying to start a defective lawn mower I just bought. Do I claim pain and suffering from Toro because I had to ret my shoulder for 2 days lol

Anyway I am not crapping on what happened to you but life is just so precious and things could have been alot worse. Sometimes its just time to move on. My mom was killed in a car accident and we could have had a huge payday but my dad did not pursue it.

Btw..wow you make alot for your age!! good for you man!!

See if Hans has any advice for you. I think he received a decent settlement some time ago???iirc not sure sometimes things just pop in my head

First off If you hadn't gotten advice from your own specialist do so. That 'injury' could come back to haunt you 10 years down the road and you won't be able to go back on them for it. So check with 'Your' Dr, not theirs, and if he says that you could have complications down the road from it then go see a lawyer.

or you could see the Injury lawyer first who I'm sure has his own experts that will say you will be crippled in a few years because of it

Okay I am not trying to get a pay day out of this. And I knew that was going to be said. The fact is I couldn't do the normal things for 2 months. I shot weddings with a sore neck for a couple of weeks (the first couple of days after I could not move my neck and I actually shot a wedding that weekend) I couldn't work out during that time and I missed a whole bunch of hours of work going to the chiro. Not to mention the gas I spent going there and stuff.

We will see what happens today I probly will not take it for a while and let them know that I wont be looking at offers for a while to make sure I am alright unless they offer me something closer to twice that amount.


This is another subject has nothing to do with pain and suffering but they gave me what 19 something for my car but I had a warrenty on that car that was $2500 that went down the drain.

By the way I work 4-10'* a week instead of 5-8'* I get Fridays off So its not as much as you think. But I am not complaining about to get a $1 more promotion within a week.

You have a strong argument, seek legal counsel before you accept and see if there is room to improve your compensation.

cheers to that pdad legal counsel is the way to go there . you might be able to talk to a lawyer and get some advice without having to shell out any money just gotta find the right one

When I sold my GXP I called the warranty company and got a refund on the unused portion of my extended warranty. Did you call them?

I forgot to mention that that second opinion I was referring to is covered by them, its nothing out of your pocket. Well its not supposed to be at least.

Yeah I used all of it so there was no balance. :( But still I put at least 2.5k into the car.

Edit: Come to think about it 2500 in 10 months for repairs on my GXP
