I think the only reason they won't pay is in the case of a DUI. Probably there are other exceptions too, along the same lines - basically if you are committing a crime and have a wreck you'd be out of luck. Of course in that case, you have bigger problems anyway.
Insurance companies are, IMO, pretty sleazy in general. But if you were at fault, and you have full coverage, they will pay for your damage and the damage to the other vehicle/property.
But get ready for a rate hike.

Well it is not looking good, I just talked to them and they said if the police charge me, depending on the charges in may not be covered :? I wont know if they are charging me until 5pm when my investigating officer starts his shift. I am thinking a car payment with no car will be a life lesson.

and due to the fact the roads were WET.. and the RSA'* really suck and what was the posted limit 80km?
if the posted was 80 and you were doing 80 your fine if they Charge you fight it... 80% chance you will win in court. And if the insurance company tries to hold out on paying go back the the scene of the accident and take pictures is it poorly lit? Bad pavement ? take all that to court with you. Driving record Clean? take that to..

I suspect he means being charged with reckless driving, or something.
Fight it. Make the authorities prove it. If no one witnessed your accident, who'* gonna testify against you? I hope you didn't confess to anything at the scene, or pay any tickets or fines yet...get a lawyer if need be.
If the cops still nail ya for some trumped-up charge, read the fine print on your insurance policy. Don't take the company'* word for it that you're not covered due to some minor traffic infraction. Make them show you a piece of paper that you signed stating that fact. Find out the laws in your state/province.
If, indeed, you DID sign such a paper (and can verify that the company has the legal RIGHT to screw you), find out if you can get your coverage back (and/or get your reckless driving charge cleared) by taking a defensive driving course.
Whatever you do, do NOT roll over for these guys. The cops, the prosecutor, the judge, the insurance company, ALL will gladly railroad you if you let them, and most will back off QUICK when they find out you're not an easy target.

As long as you didn't confess to anything, and no witnesses were present, they got nothing. Under those circumstances, I'd collect my money from the insurance company and immediately drop them. They are obviously too crooked for your money.

note as a 19 year old male in Ontario I'm paying $1800 a year just as a "3rd occasional driver" liability only on a 16 year old car whose ownership is under my parents' name
