My case is on the docket!! He has until Nov. 14 to answer my claim or he loses by default like almost every other case he'* lost (7+).

A trial would actually be sweet just so he'd be humiliated for being such an a$$. But, I do hope I win by default, because I don't own the Sebring anymore and I really don't think I'd win (all of it anyway). I will however try to get an argument in order on why I should get even SOME of the money back even though I don't own it anymore, just in case I DO go to trial. Sandrock had a good point on page 19.

I would think you not owning it anymore would be in your favor. He had such a hard time selling it that he had to start using it. Then, he gives it back to you and voom, it'* sold....

Yep, I'm well aware. This will take several more months if not a year to get the money, unfortunately. But I just want to be granted the money ASAP so I can start collecting.

Well it is a small world, but I highly doubt he would be.
Either way, he wouldn't have any advantage if he was. He'd at least have to be a registered member to see the Lounge, and this guy is not an internet forum type of person. lol

Update:
Yesterday was the answer date. I waited through the day to see if he answered my claim. Obviously he didn't and ignored the court papers for over 2 months. So soon I should hear what happens next. Most likely there will be a hearing for damages. Wish me luck. Hopefully I can get granted the whole $1299 (plus court fees).
I need to start preparing my argument so I can have a good case. It'* been a while since this all went down so I don't want to forget anything. Getting the whole $1299 may be tough.
