Might be able to get out of trouble if they have a disclaimer saying it'* not for road use, off-road only, like a lot of modding stuff, VHT, exhaust items, lights, etc...

Probably too late for that, even if it would help. But, I bet the idea of defeating the emissions control in and of itself is probably illegal no matter what

Those that have these already now have an investment. They'll triple in price.

Now what is the DOJ or the EPA going to do when they start making these in China?
