Tempo got rearended... <It'* finally over!>
So I'm coming off of the interstate, and notice a semi in the center lane with his right blinker on. i, coming up in the right lane, notice this, and stop just off of his rear end, because i have seen far too many cars get ran over by a semi in this situation. next thing i know, i get plowed by a dodge ram <late 90'* generation>. moves me up a good 8-10 feet. i get out, he gets out with the generic what were you doing lecture. he was pissed, but he was a good guy.
Damages: i suffered a busted tail light. it looks like one of the fenders and the back bumper might be out of line. he suffered a torn up bumper, mainly from the trailer hitch. i looked at the ground and notice all of the caked dirt he knocked off of my frame, and was amazed by the amount. also, the panel that goes between my tail lights may be bent a little too. also bent my seat a little bit too. i didnt get issued a ticket, i guess thats a good thing. i still gotta call the insurance company too just so i know what i can do, so they cant turn it around on me.
What did i learn? 5 mph bumpers rock!

I would think it was his fault as well. In NY, if you are rear-ended it is almost always assumed to be the person who rear-ended you unless you cut them off. In your situation, I would say that he was probably following too closely. As for insurance, I would be prepared for it to be totalled since the age of it, and all the hidden damage that there could be. if any of the body panels are wrinkled or dented, usually those under the bumper cover, that can cost some change to fix. Good luck with it. I'd say i would start looking at reasonably priced bonnevilles in the area...
