It sounds shitty, but from my experience, Drifter is right on. YOU didn't ask to get creamed. Soft-tissue injuries can't be proven or disproven, whiplash is one of these, and it is entirely likely that at some future date, the other insurance company will offer you a small cash settlement to release any future liability. This can be your nest egg for the other little problems like the brights/column thing. LUCKY for me, mine was a serious disk injury that showed up on an MRI....but this also means my settlement will be long and difficult.

When you run into problems with them refusing liability on the stalling thing or anything else, have YOUR insurance company deal with them. That'* why you pay them.

Will said it right.. let your insurance company deal with his insurance company to fight for it.. I would call your insurance company tomorrow ( if you haven't heard anything yet ) and tell them about it so they have a heads up.. and at the same time.. their going to want to resolve it with them as soon as possible because worse case scenario.. your insurance company is going to have to pay for it.. and like most peopple.. if the money is coming out of their pocket.. they're going to fight hard that it doesn't. Hit your tailights near the bottom and closest to the hit.. just make sure that it cracks enough ( and spiders ) that it looks feasible.. not busted and broken like you put a sledghammer to it...

Like Will has said best.. you didn't ask for it... that dumb A$$ wants to play that way ?? Then find.. teach them a lesson when their insurance jack up because of all your repair and compensation.. remember.. if their insurance calls you... remember that its only an offer.. and you can make a counter-offer it doesn't seem fair to you
