After reading the article, there'* no reason to get anyone involved. The non-smoking thing is a pre-employment agreement. If you agree to it, you have no complaints. I'd never work there, but there are obviously those that would love that kind of work environment.
Anyone already employed there is not affected by the ban, except to be offered help in quitting.
Now, if they use whether or not you smoke, as a pre-ban employee, as to further opportunities within the organization, then they are opening themselves up for trouble....

Holy smokes, batman! This is discriminatory. The only way this could be legally acceptable is if it were stated when you interviewed that they don't allow smokers, and you lied to get the job. I think it could also be considered constructive termination. This is when an employer gives an employee the choice to take a really big demotion and pay cut, or offers some ridiculous severance to entice them to quit.
I think anyone who gets fired for this should start shopping for an employment attorney. If your smoking doesn't impact your work performance or attendance, they shouldn't be able to do this.

i whole heartedly agree. its crap! total crap. even though i dont smoke, i would refuse to take the test also. even though i hate smoking with a passion, i would stand for what i believe. next up will be the generic beer after work routine. who cares what you do at home, so long as it is legal, and doesnt affect you at work.

I'm goin to start a business.. and say no fat women * they have a choice and can change just like smoking * .. must be single * again.. have a choice and can change just like smoking *.. and have bigger then D-cups.. fake ***** allowed. * again.. have a choice and can change just like smoking * Must be under 30 and must look good in bikini.. * can change bikini to skimpier more colorful brand * like smoke brands * to suit the needs *
And if I have it in the employment contract they sign.. then HA !!! and if it goes to court.. I can throw this smokin B.*, at them too.. Sounds kewl?
