I feel for the old lady, I really do, but seriously, you can't sue a kid for negligence. You can only be negligent when you know the consequences of your actions. Kids don't know that old ladies who fall get broken hips. You can't sue a child, simple as that. It seems that people cannot differentiate the mind and capacity of a child between that of an adult.

You can do what ever you want, don't mean it'* right. So what'* worst, the person doing the suing, the lawyer for taking her money and moving forward, or the judge for not throwing it out, or the parents of the child not accepting responsibility. I would say all of the above. My son broke things this year, over $700 in damage. I didn't hesitate and said I will take care of it. She got all cranky about it and started talking about pressing charges on my son. What ever. A week later she had her money and was still grumbling.

The judge said the child could be sued. He didn't say that the child would be found guilty. Is it dumb that it could go to trial? Yes. Will the child be found guilty? Most likely not. Will the plaintiff'* be forced to pay all court costs because of the lost? More than likely.

I personally thing it was the parents who should have taken at least some responsibility. Children should obviously be supervised a little more closely. Then again, telling a parent to take more responsibility these days is about as useless as youtube to a blind guy.

Ain't that the truth. Don't go after the kid, go after the parent for allowing their kids to do something that could have (and did) hurt somebody.

That'd be like suing my 2 year old for shoving your kid off a play set at the park. He MIGHT know that it would hurt your kid. I on other hand, DO know it will hurt your kid. I should have done everything in my power to prevent that from happening.
