Sorry, guys, the new job is killing me! I don't get much time to post lately..I do get to read at very least.

The great people at Cafepress have decided that we can't use any pictures or facsimilies of pictures of our cars. Our glorious logo is under that mess. The explaination is all legalled-up, so I won't bore you with the details. Needless to say, I am trying to find an altenative now. Hopefully the people that have ordered recently actually shipped...the site says everything ordered has shipped. We'll see...

I have asked Pontiac for a license to use the likeness of my old 98 and a friends 2002 SLE. If I get it the stuff store will be back with all the goodies - including the thongs!

Anyway...I'll try to keep everyone posted as to where and when the store again does that Superman thing....

What about the main logo on the forums? ^ I might throw my photoshop skillz together for this and send ya something too....

complinitor 11-10-2003 07:54 PM

I can use it without the car, which just doesn't look as good. Send me what ya want, but post it here for every one to look at first....that way we can gauge response levels.

Sorry to hear that although it doesn't surprise me. I recently went through a similar fiasco with an illustration I created and tried to sell as a poster through Zazzle, a site similar to Cafepress. Although in my particuar situation I believe I found a legal middle ground that will allow me to sell my images:

What you CANNOT do:

The official Pontiac and Bonneville logos are trademarks of Pontiac and cannot be used.

When used together, the words "Pontiac Bonneville" refer to a specific product and cannot be used. When you associate an image with a specific product or brand it cannot be used.

What you CAN do:

Simply refer to the club as the "Bonneville club forums" but do not show a car. Don't use the official Bonneville typeface as it refers to the actual product.

Use an image of a Bonneville, providing you do not advertise the fact that it is a Bonneville. Any logos, badges, must be stripped off the car. Also nowhere in the description of the product that bears the image can you refer to what it is. You can simply say "this is a cool car poster" but you cannot say "this is a drawing of a Bonneville." This might be tricky because if you're selling it through the club, you'll almost have to associate the image with the word "Bonneville" which is a no-no.

I'm no legal expert but it's been my experience that the above IS legal.

Maybe a solution to this dilemma would be to have a contest? I've noticed that there are quite a few design experts on these forums who have customized signature images so there wouldn't be a lack of ideas or creativity. Establish the rules and legalities of the contest, and the members could come up with a new logo for the club. If you'd be interested in something like this, send me a message and I'd be willing to help. I've run a few similar contests for other forums in the past and I'd be willing to dedicate some time in putting something together if there's any interest.

So if we showed say something like my sig with the pontiac logo removed, and some stuff we'd be cool?

It all depends. If you associate the image with the word "Bonneville" in any way, including the club name (which contains the name) you could get into trouble. This includes advertising it from a specific web page that associates itself with Bonneville.

Here's an example of what I've found to be appropriate:

http://www.zazzle.com/contributors/p...086410&index=3

Notice there is absolutely no mention of the make or model of the car in either the image nor description. Also I am NOT advertising the image through any organization that associates itself with any specific model or manufacturer.

Again, I'm no legal expert and I may be wrong but this is just based on my experience and observations. Although to be absolutely on the safe side, I still think developing a custom icon or logo for the club would be the safest bet. And I'd be willing to wager that if a contest were announced, there'd be at least two entries...one from you and one from me. Couldn't hurt.
