What'* my recourse?
I bought this item on ebay. It arrived (packaged very well) and it works very poorly. CDs skip, the motor to spin the CD makes a ticking noise, and sometimes the player will play the same segment over and over and over. Basically, useless to me.

I emailed the seller and haven't heard back from him. I've never had this situation on ebay before so I'm not sure what the best way is to proceed. I payed with Paypal, if that matters.

Not sure what your recourse will be, but it does say factory refurbished and also says sold as is. But it doesn't say if it functions properly or has any problems with it. That may be a tough one.

With all the hassle you would have to go thru, it may be more practical to just cut your loss.
It cannot be proven if he knew it was bad or if the postal service damaged it during shipping.
I am not trying to sound negative, but I really don't care for e-bay.
Even if they have a lot of positive feedback, that can be falsely generated.
And then the seller could try some tricky crap like saying - "Well, it is your fault, it says in the ad that... (something bad)"

You can get your money from Paypal. You have to file a claim that you didn't receive, or it was significantly different than described. It usually takes some time, but you will get taken care of.

Thats why I hate Ebay. I only get stuff from there that I know are good or if I have recourse. I got ripped off once for a computer processor. Buyer beware. Ebay is over-hyped.

The way I see it, the seller was dishonest to tell you it was recently factory refurbished if it isn't working (properly).
Did you happen to see the paypal info right under "seller information" in the auction???
