Default No Christmas cheer for me

Well as many of you know I recently had a new longblock put in to my car. I was having issues with oil pressure because of what I believe to be a bad install of the front cover. After much disscusion with the mechanic I was told that I would be able to drive the car and he would work on resolving the issues. He thinks the company I got the longblock from is responsible because they didn't inform him that th front cover should be replaced or machined. He did niether. All the same, yesterday on my way to my kids grandparents for Christmas, I spun a bearing. (I know what it sounds like now after the last motor) I am at this point devestated. I really don't know what else to say at this point other than that. I'm devestated. I'll keep you all posted on the progress of getting this fixed. I'm not home yet so there'* not much I can do now other than be very sad. This truly sucks at the worst possible time imaginable.

Didn't that mechanic tell you the oil pressure was 'fine' ???? If so, and it proves that it WASN'T, he should at least share the blame. Hope this works out well in the warranty department.

I think that he'* still responsible. It follows basic consumer protection laws, and business laws. Even if a "middle man" sells a product, uses it, etc, he'* still liable for that product, under US law. But his advice told you that the car was fine, if you have that in writing, and you also have that the spun bearing in writing, you will nail him.

Whatever you do don't leave it with the mechanic that told you its ok to drive. At this point nearly every mechanic goes into "Save my ***" mode. If you think you've been lied to about needing winter air in your tires and it'll cost $50 ea, try bringing back a blown motor to the guy thats essentially responsible for its destruction. If you haven't already, take it to another mechanic and have him diagnose the problem and document it. Have him write up an estimate on costs. Tell him you need the maximum it would cost. Then call 2-3 other places and ask their high end estimate. Take the high of what they cost and that should be what you seek. I would demand the mechanic pay half of replacement then demand the company give you a replacement at half price. That is if the engine needs replacement, which it probably won't. Otherwise do the same half/half with the costs of repair. If they absolutely refuse then go to Kinkos or somewhere similar and browse through their legal paperwork section. Find papers relevant to the situation and basically fill in the blanks. Mail that off with a nicely typed up demand letter and wait for a response. Otherwise go to your courthouse and file for small claims court. You'll have to ask how much small claims court is where you are, here in washington its anything under $4000. File a claim and mail off the papers certified mail/signature required. That way they can't claim they never got it. I'm really sorry to hear about your engine, looks like we're in the same boat! Let us know how things go with it.

Well at this pont it'* finger pointing between the two. I will get an independant mech to look at it but for warranty reasons I'm going to have to pay someone to pull the motor and ship it back to where I got it for " engine failure" analysis. I hunted down the instaleller as well and he'* saying the the front cover would do this and he thinks a bearing or something they sent with the motor is/was out of spec. I also already have an attorney (a real *** too, which is what I wanted) ready. It sucks that this will be more money out of my pocket but I will not give up on this car now. I've put way to much into it.

Sorry to hear. All I can say is cover your *** with as much paperwork as you can. Gather everything you can (labour bills, invoice for the block, etc.), write down how it all went down and date it all!

You have a case if this guy says it is all on you!
