Default Cam sensor + garage screw up

ok...so heres the story..blew my transmission a couple months ago..its been down hill from there...firs tthe check engine light came on very little..like once every couple days...noticed no difference..so let it go...but then it started to become solid..
so i went to a garage to have it looked at. scan confirmed cam sensor code. so...he tells me he went through every possible problem and its the cam sensor itself... 120 bucks for a part thats normally 40 bucks online...but ok fine..just fix it. so he fixes it...car just didnt feel right..but light was off...i call him and tell him..he said if it doesnt feel right in a week call me. well i barely drive anywere cuz im on vacation. but i drove it to the store..4 miles..popped on..went off..drove 80 miles the next day.....NO light..ok..good right...4 days later..drive to the store again...light solid entire time..car feels terrrrriibbllleee
so i call the guy who fixed it..hes out of town this weekend..so im goin in on tuesday.

now my questions..
if he scans and its the SAME code..which straight up means...he messed up the diagnoses...is he resonsible for PARTS and LABOR? cuz i had to shell out 120 bucks for a part that didnt do ****..why must i pay for his mistake? he was wrong and it cost me all that plus labor..
like if i need a new wire harness...am i responsible for for the cost? and what if i buy it and it doesnt work AGAIN..i have to drive 1200 miles in one week back to pgh..so even if this does temporary fix it..id have to pay the costs all over again...so the guy gets 400 bucks..and nothin is fixed. i am in a quite an odd and rare predicament!!!

HELP!!!!!!!!!!!!!
