and a rate hike they will...
it will most likly be a 50-50 fault and Both of you will get the hike.
and the insurance company would possably ask for some $$ back.

Show up and dont let him get away with it.
most cases like this after 2-3 months they (fault drivers) expect the other driver will not
show up. and can easely win.

he will lose.

so if i show up, i win the battle, if i dont, then he does?

also, he is claiming that i stopped short of the intersection for no reason, and that my brake lights were inoperative.

shouldve been looking in your rear view mirror at the right time. I avoided a really bad accident by, you could say, obsessively looking in my mirrors all the time. Someone going 75 or 80 not stopping and light now red, I floored it up the curb through somebodys garden, tore up all their tomatoes.

I am determined to keep my car unscratched. I will do whatever it takes..if that means mowing down cat/dog whatever. I had to weave through oncoming traffic one day in june because some dumb foreignor moron in a Ford Escape made the turn on red, but stopped in middle of road because a guy on the right of me was already turning. Had i slammed the brakes, i wouldve slid right into em. Or if i had weaved right, I still wouldve scraped the guy on the right. Instead, I floored the gas in and out of several oncoming cars, including a semi. Then blasted down the center, made sure noone coming behind me and blasted right over to my lane again. Woot.

RJ.. I once became the center of a Celica, Grand Am, Work Van sandwich. Celica cut in front (less than 3 feet type of thing) and locked the brakes. Van and I stopped exchanged info and called the cops only to find out she called moments earlier.

Nothing seemed to come of it. A year later my insurance company was asking me what happened because she was looking for damages. She got my plates when I went after her to keep her from fleeing the scene.

I still had the other guys information and provided it to the insurance company. She lost. It is all about being there in your case.

Sounds like you may have been moving slower, but not breaking the law. He then did something that resulted in him hitting you.

Holy crap maybe I should have gotten a escort instead of a explorer. Aparently the escorts fair better. As for the court date I would show up with a lawyer by your side. Trust me some people have no problem rewriting history to get out of trouble. you don't want the other driver telling the judge that you had no brake lights and were speeding then made a abburpt stop cause I wouldn't be suprised if his story goes to that effect.
