my families black lab got hit at ~45 when he broke the chain. The driver of the neon tried to press charges because apparently he hit the hood, bending it and put a large crack in the windshield.

well anyway its his loss because insurance doesnt cover anything unless a police report was filed and makeing a bogus police report is fraud
insurance would cover it under comprehensive and most companies don't require a police report for hitting an animal. It is very common.

As far as the situation- he shouldn't have been speeding if he is going to be preoccupied doing other things. I text with my phone and talk on my phone but I try to be more careful if I'm doing that. I don't speed.

I think the big thing here is-it could have not been a dog, and it might be a person next time. We're glad you are okay and yes, it was just a dog (even if it was someone'* dog who meant alot to them-it was still just a dog, could have been worse), but everyone should take this as lesson to slow down, pay attention for their own sake and anyones who'* around the roadway.
