Well if you read the topic title you can see were this is going I just need to vent my frustrations.

I got a letter from the insurance company. What I thought would be a nice check ended up as a "liability denial letter" in other words they're not paying. it bugs me that even though I was driving safe and not breaking any laws and that some idiot who was not only speeding but swung into my lane and plowed into me doesn't get blamed :(

AAAAAAH!!

this cant be good. as long as the other person had insurance, and was cited for the accident, you should get a check. would it be too much to ask to scan this letter in and post it <edited of course, wouldnt want ID theft now>. this clearly isnt right.

btw, did they say why?

But really, insurance companies do this kind of crap all the time. My wife was rear ended in her new GA. We got an estimate from the largest, busiest shop in town, then the insurance sent us a check for $250 less citing their records indicate it should be less, SITE UNSEEN OF THE CAR. They really had no idea of what was actually damaged. After an angry call from me, they said if the amount was confirmed, the extra money would be sent to the shop to guarantee they did the repair. So I just buffed out the scratchs, leaving cracks only seen from the under side. The shop would have replaced the bumper cover and painted it. We put the money in the bank.

Comp isn't working right now so I can't get the letter up right now but ill qoute what it said

"Our liabilty investigation into this matter has been completed. It reveals that our insured (idiot who hit me) was not responsible for the above captioned accident. Our insured'* statement as well as the police report and witnesses clearly state that you proceeded though a red light causing the accident. We will not be making any voluntary payments in regards to this claim"


Still scratching my head because in new york as any other ny member knows who ever is the driver who hits into the driver is responsible and even the way my frame bent you can see he hit me

what happened that would make them claim this? was it yellow? did the witnesses say you ran a red light? the guy you creamed?

Now..I've double posts..but that really takes the cake. If you didn't run a red light, then either call or write and clear up the problem Maybe they misinterpreted the statements that the other guy might have run a light.
