UPDATE: Well I kind of thought this would happen, but they tried to give me suggestoins as to what to do:

After reviewing this situation, I found that the purchase that you
reported took place outside of the eBay site. Items purchased outside of
eBay include those bought directly from a seller, item listings that
ended with no high bidder, and item listings that did not meet the
reserve price on eBay. Since this item was purchased outside of eBay, it
is not eligible for eBay'* protective services, such as transactional
feedback, requests for contact information, or our Standard Purchase
Protection Program. Those services are only available for items listed,
bought, and sold on eBay in compliance with our guidelines and policies.
At this time, I would like to review some options that I feel you should
pursue based on the information available to me. Since eBay is not
involved in the actual transaction that takes place, I am unable to
directly intervene; however, I can provide some suggestions that may be
of assistance. Some information about the options I am going to discuss
can be found at: "BLAH BLAH BLAH...."
She said I could go to law enforcement or the IFCC (internet fraud complaint center) but those seem a little too far since I'm 90% sure this guy did not intentionally try to rip me off, although he may have, who knows. I filed a complaint with Paypal since I purchased the seats through Paypal, asked for a refund from Paypal and I emailed the seller again asking for a refund, and he'* still avoiding the issue. I hope I can get my $406 back.
