Default ..Can I file for harassment?

Here'* the story..prepare to lose a few minutes of your lifetime..

There'* this girl at work. she makes fun of me left and right.. calls me fat, stupid, ugly, retard, idiot, moron, and everything imaginable. it hurts me greatly and i never show my feelings or say a word back.

I went in to pick up my check like an hour and a half before work so I could cash it to get some gas and some other **** I needed.. And she'* like 'ya work tonight?' and i said "So you can pick on me?" and she went "haha yup you f***n dumb**..it'* so fun" and i just walked away.

I returned at 5 for my shift, I drove through the parking lot, then in front of the store to get to the back employee lot where I park, and there'* automatic doors.. She was "helping a customer to her car" or so she told the manager, and I flew up doing about 35 Mph and locked up my brakes. She told the manager I peeled out after that, and almost hit her.. When I rolled up doing 5-10 MPH, didn't make any abrupt movements, stopped fully for two seconds as I've been doing (got written up before for speeding through the lot and i have kept my foot under control since then in fear of another writeup as my manager told me that it'd result in separation from the company if i got another..) and i got ******* written up. No customer complaints, and they believe a girl who makes fun of me horribly in front of the managers. I got written up for harassment, after her approaching me when I was clocking in, and she said "You almost hit me.." What I said in response was "I wish i would've.. get off my back please"

Result? Manager calls me into his office 1 hour shy of my time to clock out, (9PM) and..basically, he sits me down to tell me I've been given a write up and a Two day "Suspension" From work and I need to talk to the manager on monday who told me I'd be 'separated' if another thing occured.

What I'm going to say before I even sit down in the chair to face to face talk is "I'd like to say a few things before you even get one word in.." and tell him how I feel and it hurts me greatly that even she'* stood in front of a manager with me talking to him, rudely interrupts us, and acts like a five year old saying these remarks dead on to my face and the manager tells her to "Grow up and if you dont have anything nice to say don't say it"

I've asked a manager if she'* been written up for this, he'* said "no i don't believe so.."

This girl makes slanderous remarks about me behind my back to people, and harasses me to my face and also behind my back and then I'm told about it, making me more edgy about the whole situation..

My mom is a food service general manager for 5 of the local schools.. she knows everything from the EOE (equal opportunity employer) thing.. and that harassment in the workplace is illegal. There is nothing being done about this stuff being said to me, MIND YOU EVEN WHEN THE MANAGER SEES/HEARS IT WHILE BEING FACE TO FACE WITH ME!

The question is.. what can I do in this situation?

Either way, I think my *** is grass on monday..

dude.. I'm going to be totally honest here. Kids THRIVE on picking on someone if they know that it bothers you. Ignore it. Don't let it bother you. Don't show that it bothers you. They'll eventually get bored and leave you alone. Don't act like it pisses you off (like it does.) People LOVE to see that and will do it even more! Trust me man.. I've been in similar situations before. ..

I'll probably get ripped for this, but no, you probably can't do anything about this.
Women get a double standard when it comes to workplace harassment. Verbal things that would get a man fired pretty quickly will usually be overlooked in a woman, unless she says it directly to a manager or an influential employee.
I've had some experience with this one myself. When I worked security, we had a female guard that was pretty sh*tty to her co-workers. She was vulgar, rude, and vocal about things she didn't like in other people. She never got called on it by our captain, but when I told her one night that she should "get f*cked, it might improve your mood", she went to the captain and complained, and I got called on the carpet. When he tried to send me home for the day, I threw my badge at him and told him to go f*ck himself. I went off on him for ignoring her foul mouth and finally managed to get her written up for some things that other people backed me up on. What made it worthwhile was the fact that she went off on him and did her usual foul-mouth crap on him during their little meeting and got herself fired.

About a month later I quit when some old lady threw a smoking area chair at me.

I've even prepared a letter to print up and leave in an envelope on his desk.

" Dear Jim,

Regarding Deborah,

How this girl is acting is unlawful, and I believe it'* ridiculous nothing is done about it. I have no problems with anyone else who is an employee at Butera. When I'm not present, others tell me that while I was gone or not there, she was making remarks about me behind my back on several things, me not being "as smart" as everyone else, being "retarded" When I'm not, I just have alot of trouble paying attention to things, then to my face, when I ask her about it telling me "you and your opinions both have no place being here" makes me feel pretty low.

You being an employer, would hopefully know that this is illegal as per the Civil rights act of 1991, Section 3, part one;

The purposes of this Act are-

(1) to provide appropriate remedies for intentional discrimination
and unlawful harassment in the workplace;

(2) to codify the concepts of "business necessity" and
"job related" enunciated by the Supreme Court in Griggs v. Duke
Power Co., 401 U.*. 424 (1971), and in the other Supreme Court decisions
prior to Wards Cove Packing Co. v. Atonio, 490 U.*. 642 (1989);

(3) to confirm statutory authority and provide statutory guidelines
for the adjudication of disparate impact suits under title VII of the
Civil Rights Act of 1964 (42 U.*.C. 2000e et seq.); and

(4) to respond to recent decisions of the Supreme Court by
expanding the scope of relevant civil rights statutes in order to provide
adequate protection to victims of discrimination.

Her acts are, illegal as per these statements.

Anytime her and I are scheduled the same time, she harasses me, and makes me feel pretty low about myself, which NOBODY should deal with, especially in a workplace when there'* even laws against it. I can't even come into work on the same day when she'* there and not feel completely violated with how she treats me and it disgusts me that I have to say these things because nothing is done.

Everyone witnesses her treating me like I'm nothing, when in fact, there is not one person on this whole earth that is nothing, so why isn't a thing being done about it, especially when it'* ILLEGAL?"

Good/bad? Add / remove things? I'm guessing with the mature crowd here I Can get some pointers. I've got til monday.

Hell, maybe I'll man up and sit down and just let him read the paper, minus the 'dear jim' (who'* general manager at this store)

Then just smile and say "This isn't right. Something needs to be done and actions need to be taken to safeguard this from happening in the future to the next bunch of employees."

Sucks, but damn little. You can try, and it might be worth the effort, and bring it up when you file for unemployment in case your employers contest your claim for unemployment compensation.

Suggestions for retribution on the B****. Memorize her name, address, license plate, and wait six months till winter is upon you. Then, take out a little payback on her parked car. A pellet gun will take out most car windows, battery acid/chemical stripper does wonders on auto paint. Repeat application on a random basis. The effect is mostly psycological. Let her spend a few years looking over her shoulder wondering who she pissed off.

Don't get caught and don't ever admit it. If ever questioned the correct answer is that you don't know anything about anything, your just minding your own business. It'* not what they suspect, it'* what they can prove that counts. If you encounter her again in life, resist the urge to say anything to her like "Howd ya like that you c***"...though overt rudeness is acceptable if you feel the need.

Other suggestions. Buy an old $100 beater car in a private sale, pay cash, and don't register it (better yet, have a buddy buy it and pay cash) Then just park it next to hers so close she can't get in her car. If it doesn't get towed away the first time, double park it behind her so she can't leave the store.

If she changes jobs, make a point to visit her new employers and be exceptionally rude. You can also trash her reputation with her new employers at your discretion.

That'* just a few random ideas for you to consider. BTW, your former manager is also fair game. Same rules apply.
Girl'* nineteen. She has a liscense, but no car. Uses sisters. Please don't get my thread locked. Keep this on topic, about what I can do to fix this, not get back at her..

it would most def be good to keep this thread on the legal side of things.....I mean we all have our urges but yea no sense going to jail for some girl that said some mean things to you........look at it this way if you did do something to her and did get caught and went to jail or was fined....she would get a kick out of it in the long run anyways.....imo....I would sit down with you managers and explain to them how she makes you feel and if you have any co workers who have witnessed to step forward in your behalf....and if all else fails just look at the bright side of things you can file for unemployment.....and she is out of your life....

As you wish. I withdrawl my comments, but leave you with one based on my 40 years of life experience. You are probably screwed with no recourse. You are neither female or a minority and therefore on the loosing side of a double standard when it comes to harrasment. Good luck trying to find anything resembling justice in this situation.
