The second pic of the intake shows current with the AEM by-pass valve.
If air can go through there, that'll disrupt flow a lot. If it'* there to relieve engine torque i can see it being useful, but he'* got the rubber boot there already.

the only point of this is in case the filter element gets doused in water...like in a true under car CAI... if you drive through a puddle and water saturates the filter element then the bypass does the filtering untill the filter element is dry again....pointless for any CAI ive seen on a Bonne, as most of them are under the hood.
