GOD FORD SUCKS!!!!!!
Ok, so i'm going along at the normal pace for this road 60-65 MPH (limit is 55). there is a white truck ahead of me, and a something in front of it. well that something decides it has to make a turn in 100 feet. so it nails it'* brakes, the truck nails it'* brakes, and i nail my brakes and go for the median, problem avoided right? WRONG! i look in my rearview in time to see this ford escort waggon comming at me, and sure enough .5 sec later, it hits the side of my car. well it creases my rear 1/4 panal (the one that continues up and is the roof and all the way to the other side)... and all of this happened because ford didn't include ABS on the escort in 1998... common people 19 fooking 98, cant you put ABS on a car... GOD FORD SUCKS!!!!!! oh, and the body molding on that side of the car is lifted up from the bottom... so, answer me this, am i within my rights to get the guy to pay to replace the whole piece (he is paying out of pocket)

No insurance? hes insurance should pay... but im not totally getting the situation.. So you swerved into the oncoming lane to avoid an accident, only to find a ford escort was trying to pass you? This one could be on you... or... your insurance... Sence you where following to close? im not sure...

ah-ha!
Well.. Yeah.. his problem.. If he wants to pay outta his pocket good for him... I quess hes under 25 and doesnt want X% added to his monthly insurance?

Yes Boat!! Whether he'* paying out of pocket or not, you're entitled to have your car in the same condition it was in before the idiot hit you! I would have the whole panel replaced and the molding he fuct up. Go for it.
My brother backed into my car (you probably remember) with his g/f'* parents' van. They payed out of pocket, but they wanted me to go to the cheapest shop, ones that I didn't trust. Well since it'* my right to take my car where I want, I did just that. But the shop said they'd keep the bottom molding he damaged and wouldn't blend the hood too to save them money, but I told them to replace it and paint the hood. And they did.
That guy should pay for everything. He hit you, he'* outta luck. That'* what he gets for driving a POS.
I actually wish someone would hit me on my left rear quarter panel so I can get my rust fixed for free.
