Default Transmission issue, no SES light, slow into OD

As Whitesnake said, Here I go again....

Just replaced my transmission 4 months ago and it'* already starting to act up. All of these symptoms just started two days ago and won't go away.
#1 it'* REALLY slow to go into overdrive. It doesn't slip, it'* just really slow; usually takes 2-3 seconds
#2 Whenever I start moving from a stop, it lurches forward after a second, around 5 mph. That'* the part that has me freaked out.

So has anyone had this problem before? What do I do about it? Do I sell my car and swear off the 3800 forever? Maybe not, but I'm close. I'm starting to believe that these cars hate me

Edit...

#2 has went away completely. #1 is still there. Doesn't seem to change with temperature, but sometimes the TCC is very slow to lock up. Don't know why. I'm gonna get the SES scanned tomorrow hopefully.
