Default tranny again

i was drivin through a residential area last night when a guy ran a stop sign, i had to punch it to avoid getting hit but my car seemed like it was in nuetral, it just came out of gear, i brought it back to the shop that rebuilt it last month and he said it was low on fluid ( it was really low) anyways, he filled it up and sent me on my way. but my car started smokin out of the exhaust again so i brought it to a different shop and i asked him if it was possible for tranny fluid to get into my engine, he said ya and took the vac hose of the valve on the front of the tranny and noticed there was tranny fluid in the line and that its putting fluid into my intake making it smoke, does that sound right? please help

Oh its a modulater, ya they put a new one on but its not nearly the size of the old one, maybe this one is just faulty?

Isnt there a one-way inline between the modulator and vacuum that goes to intake?
